Terms & Conditions
These Terms & Conditions ("Terms") apply to the use of the services provided by Trinity Creative Ltd ("Trinity", "we", "us" or "our").
By engaging Trinity for our services, you agree to these Terms.

2. Our services
Trinity provides creative and digital services which may include, but are not limited to:
branding and visual identity;
graphic design;
website design and development;
digital design;
photography and creative services;
creative direction;
marketing and other related services.
The exact services, deliverables, timescales and fees for each project will be agreed with the client before work begins.
3. Proposals and quotations
Any proposal or quotation provided by Trinity will outline the agreed scope of work, deliverables, estimated timescales and fees where applicable.
Unless otherwise stated, quotations are valid for 30 days from the date issued.
Work outside the agreed scope may incur additional charges. We will discuss any significant additional work with the client before proceeding.
4. Client responsibilities
The client agrees to provide Trinity with the information, content, materials, feedback and approvals reasonably required to complete the project.
The client is responsible for ensuring that any materials supplied to Trinity, including photographs, text, logos, fonts, video, artwork or other content, can legally be used for the intended purpose.
Delays in providing required materials, feedback or approvals may affect the agreed project timeline.
5. Project timelines
Trinity will make reasonable efforts to complete projects within the agreed timeframe.
Project timelines may change where there are delays caused by the client, third-party suppliers, technical issues or circumstances outside our reasonable control.
Where a project is delayed significantly due to a lack of client feedback or materials, Trinity may need to revise the delivery schedule.
6. Revisions and additional work
The number of revisions included in a project will depend on the agreed scope.
Requests that substantially change the agreed direction, brief or deliverables may be treated as additional work and may incur additional fees.
Any additional fees will be discussed with the client before the additional work is carried out.
7. Fees and payment
Fees and payment terms will be agreed with the client before work begins.
Unless otherwise agreed in writing:
invoices are payable within the payment period stated on the invoice;
deposits or advance payments may be required before work begins;
Trinity may pause work where invoices remain unpaid;
additional work outside the agreed scope may be charged separately.
All fees are exclusive of VAT where applicable.
8. Cancellation
Either party may request to cancel a project.
If a client cancels a project after work has started, the client remains responsible for payment for work completed up to the cancellation date and for any approved expenses or non-refundable third-party costs incurred on their behalf.
Any deposit or advance payment may be non-refundable where it relates to work already undertaken or costs already incurred.
9. Intellectual property
Unless otherwise agreed in writing, Trinity retains ownership of its original concepts, proposals, unused designs, working files, source files, templates, processes and other materials created during the development process.
Once all agreed project fees have been paid in full, the client will receive the agreed rights to use the final approved deliverables for the purposes specified in the project agreement.
Third-party materials, including fonts, stock photography, software, plugins, templates and other licensed assets, remain subject to their respective licence terms.
Unless specifically agreed otherwise, Trinity is not required to provide editable or source files.
10. Portfolio and promotional use
Unless the client requests otherwise in writing, Trinity may display completed work in its portfolio, website, social media, awards submissions and other promotional materials.
Where a project is confidential or subject to a non-disclosure agreement, Trinity will respect the agreed confidentiality requirements.
11. Website hosting and third-party services
Where Trinity provides website development, hosting, domain, SSL, plugins or other third-party services, these may be subject to separate terms and fees.
Trinity is not responsible for changes, interruptions, failures or losses caused by third-party providers, including hosting companies, domain registrars, software providers, plugins or external platforms.
12. Website content and functionality
Where Trinity develops a website, the client is responsible for ensuring that all final content supplied or approved by them is accurate and legally compliant.
Unless specifically included in the project scope, Trinity does not provide legal, tax, accessibility or regulatory advice.
The client is responsible for ensuring that their website complies with any laws, regulations or industry requirements applicable to their business.
13. Liability
Trinity will provide its services with reasonable care and skill.
To the extent permitted by law, Trinity will not be responsible for indirect or consequential losses, loss of profits, loss of business, loss of revenue or loss of data arising from the use of our services.
Nothing in these Terms limits or excludes liability where it would be unlawful to do so.
14. Force majeure
Trinity will not be responsible for delays or failure to perform its obligations where this is caused by circumstances outside our reasonable control.
This may include serious technical failures, internet or hosting outages, natural disasters, government action, industrial disputes, or other circumstances that could not reasonably have been anticipated or prevented.
15. Confidentiality
Both Trinity and the client agree to keep confidential any commercially sensitive or confidential information received from the other party in connection with a project.
This obligation does not apply to information that is already publicly available or that must be disclosed by law.
16. Governing law
These Terms are governed by the laws of England and Wales.
Any disputes arising in connection with these Terms will be subject to the jurisdiction of the courts of England and Wales.
17. Changes to these Terms
Trinity may update these Terms from time to time.
The latest version will be published on this website and will apply to future projects and engagements unless otherwise agreed in writing.
